These Terms of Use ("Terms") govern your access to and use of the websites, software, and services provided by Infyterra Technologies (a division of Infycons Creative Software Pvt Ltd) under the AutoTerra brand. By accessing or using the Services, you agree to be bound by these Terms.
By creating an account, downloading software, or otherwise accessing the Services, you confirm that you are at least 18 years old, have the authority to bind the organisation you represent (if applicable), and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
These Terms apply to the autoterra.net website and all AutoTerra software products. Use of the software is additionally governed by the End User Licence Agreement (EULA), which forms part of these Terms.
Some features require an account. You may register using an email address and password or by linking a Google or Microsoft account. You are responsible for:
We reserve the right to suspend or terminate accounts that contain false information, violate these Terms, or pose a security risk.
AutoTerra products are sold on a subscription basis for terms of 3 months, 6 months, 1 year, 3 years, or 5 years (availability varies by edition). Subscriptions begin on the date of purchase and activate the named licence for the selected term.
3.2 Pricing and taxesPrices are displayed in INR (inclusive of applicable GST at 18%) for Indian customers, and may be quoted in USD or other currencies for international customers. All prices are subject to change with reasonable notice prior to your renewal date.
3.3RenewalsSubscriptions do not auto-renew unless you explicitly enable auto-renewal in your account settings. We will send a renewal reminder at least 30 days before expiry. Upon expiry, access to the software will revert to read-only mode; project files remain accessible.
3.4 RefundsWe offer a 7-day refund window for new subscriptions (excluding upgrades and renewals) provided the software has not been used to process production data. Refund requests after 7 days or for subsequent subscription terms will be evaluated on a case-by-case basis. To request a refund, email billing@infycons.com.
3.5 Licence seatsEach subscription licence is for a single named user. Floating or concurrent licences may be available for enterprise customers — contact our sales team for details. Sharing login credentials or licence keys between multiple users is a material breach of these Terms and the EULA.
All rights, title, and interest in and to the Services — including software code, algorithms, UI design, documentation, trademarks ("AutoTerra," "Infyterra Technologies"), and brand assets — remain the exclusive property of Infycons Creative Software Pvt Ltd and are protected by Indian and international intellectual property laws.
Nothing in these Terms transfers ownership of any intellectual property to you. Your use of the Services grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for your internal business purposes during your subscription term, subject to the EULA.
You retain ownership of all project data, survey datasets, point clouds, drawings, and other files you create or upload using the Services ("Your Content"). By using the Services, you grant us a limited licence to process Your Content solely to provide the Services (e.g., to save files, render previews, compute results).
You represent and warrant that you have all rights necessary to upload and process Your Content and that doing so does not infringe any third-party rights or violate any law.
The Services integrate with or link to third-party services (e.g., Google, Microsoft for social login; Razorpay for payments; ipapi.co for geolocation). Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the practices or content of third-party services.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY.
We do not warrant that the Services will be error-free or that any specific computation result is accurate for a particular professional application. You are responsible for verifying that outputs meet the standards required for your intended use, including any applicable regulatory or safety standards.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INFYTERRA TECHNOLOGIES AND INFYCONS CREATIVE SOFTWARE PVT LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICES IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) INR 5,000 (OR EQUIVALENT).
Some jurisdictions do not allow exclusion of implied warranties or limitation of liability, so the above may not fully apply to you.
You agree to indemnify, defend, and hold harmless Infyterra Technologies, Infycons Creative Software Pvt Ltd, and their directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Services; (b) Your Content; (c) your violation of these Terms; or (d) your infringement of any third-party intellectual property or other right.
Either party may terminate the subscription at any time. We may suspend or terminate your access immediately and without notice if we determine that you have materially breached these Terms or the EULA, engaged in fraudulent activity, or pose a security risk.
Upon termination: your licence ends; you must uninstall all copies of the software; you may export Your Content for 30 days post-termination via our data export tool. Sections on IP, liability, indemnification, and disputes survive termination.
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms shall first be referred to our customer support team for good-faith resolution. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the Arbitration and Conciliation Act 1996 at a venue in Kochi, Kerala, India.
Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm.
We may modify these Terms at any time. We will notify you at least 14 days before material changes take effect via email or an in-product notice. Continued use of the Services after the effective date constitutes acceptance. If you do not agree, you may cancel your subscription before the effective date for a pro-rated refund of unused months.
