This End User Licence Agreement ("EULA") is a legal agreement between you (an individual or a legal entity) and Infycons Creative Software Pvt Ltd ("Infyterra," "we," "us"). By installing, copying, or using AutoTerra software, you agree to be bound by this EULA. If you do not agree, do not install or use the software.
This EULA governs your use of the AutoTerra software application (including all editions: View, LT, Standard, Spatial, Pro, Pro Spatial) and any associated documentation, modules, updates, and patches (collectively, the "Software"). Your use of the Software is also subject to the Terms of Use and Privacy Policy
Subject to your compliance with this EULA and payment of the applicable subscription fee, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to:

You may NOT:
The Software requires online activation at first launch and may require periodic re-validation of your licence. Each named-user licence permits installation on up to two devices simultaneously (e.g., a desktop and a laptop) used exclusively by the named individual. Using a single licence on devices used by different individuals is prohibited.
In the event of hardware failure or change, you may deactivate and reactivate the licence a reasonable number of times. If you encounter activation issues, contact support@infycons.com.
Floating (concurrent) licences and multi-seat deployments are available for organisations; terms are governed by a separate Enterprise Licence Agreement. Contact our sales team for details.
Active subscription holders receive all minor updates (bug fixes, patch releases) and major version upgrades within their licensed edition at no additional charge during their subscription term. Updates are delivered via the in-app update mechanism. We are not obligated to release any specific update or to maintain backward compatibility with any particular file format or operating system version.
We may provide a free trial period (typically 30 days) for evaluation purposes. Trial use is subject to all restrictions in this EULA. Trial licences may have reduced functionality. Using trial keys beyond the permitted evaluation period, or creating multiple trial accounts to extend the trial period, is a breach of this EULA.
The Software may include open-source software components. Such components are licensed under their respective licences (e.g., MIT, LGPL, Apache 2.0). A list of third-party open-source libraries used and their licences is available within the Software under Help → Third-Party Notices. To the extent required by those licences, the terms of those licences will apply to those components in lieu of this EULA. Nothing in this EULA restricts your rights under, or grants you rights that supersede, the terms of any applicable open-source licence.
The Software may collect anonymised usage telemetry (feature usage frequency, crash reports, performance metrics) to help us improve the product. No project data, survey coordinates, point cloud data, or personally identifiable content is included in telemetry. You may opt out of telemetry at any time via Software Settings → Privacy. Telemetry collection is further described in our Privacy Policy.
The Software, including its code, algorithms, user interface design, icons, documentation, and all derivative works, is and remains the exclusive intellectual property of Infycons Creative Software Pvt Ltd and is protected under the Copyright Act 1957 (India), the Patents Act 1970 (India), applicable international treaties, and other intellectual property laws. The trademarks "AutoTerra", "Infyterra Technologies", and associated logos are registered or unregistered marks of Infycons Creative Software Pvt Ltd. Unauthorised use is prohibited.
THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF COMPUTATIONAL RESULTS, AND NON-INFRINGEMENT.
We do not warrant that the Software will be error-free, uninterrupted, or free from viruses. You assume all risks associated with the use of the Software and the accuracy of outputs for professional engineering and survey applications. Always independently verify critical calculations against applicable standards.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INFYCONS CREATIVE SOFTWARE PVT LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF DATA, LOSS OF PROFIT, BUSINESS INTERRUPTION, OR LOSS OF PROFESSIONAL REPUTATION — ARISING OUT OF OR IN CONNECTION WITH THIS EULA OR THE USE OF THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY UNDER THIS EULA SHALL NOT EXCEED THE TOTAL SUBSCRIPTION FEES PAID BY YOU IN THE 12-MONTH PERIOD PRECEDING THE CLAIM.
This EULA and your licence terminate automatically without notice if you breach any of its terms. Upon termination:
We may also terminate this EULA for convenience with 30 days' written notice, in which case you will receive a pro-rated refund of any prepaid subscription fees for the unused period.
Sections 9, 10, 11, 13, and 14 survive termination.
The Software may be subject to export control laws of India and other countries. You agree to comply with all applicable export and re-export control laws and regulations.
You represent that you are not located in a country subject to sanctions by the Government of India or listed on any restricted-party list maintained by India or the United States.
This EULA is governed by the laws of India. Any disputes arising under this EULA shall be resolved in accordance with the dispute resolution provisions in the Terms of Use. The courts at Kochi, Kerala, India shall have exclusive jurisdiction for any matters not subject to arbitration.
This EULA, together with the Terms of Use and Privacy Policy, constitutes the entire agreement between you and Infyterra Technologies regarding the Software and supersedes all prior or contemporaneous agreements, representations, or understandings. If any provision of this EULA is found to be unenforceable, the remaining provisions will continue in full force. Our failure to enforce any right under this EULA shall not constitute a waiver of that right.
